Care este procedura?"},"content":{"rendered":"<p><strong>Legisla\u021bia care vizeaz\u0103 procedura de autorizare a lucr\u0103rilor de construc\u021bii locative \u00een cadrul gospod\u0103riilor, propriet\u0103\u021bi private, a fost modificat\u0103 \u00een luna februarie 2020. Astfel, persoanele care doresc s\u0103 construiasc\u0103 trebuie s\u0103 preg\u0103teasc\u0103 mai pu\u021bine acte, iar certificatele de urbanism sunt elaborate doar \u00een baza actelor pe care le de\u021bine administra\u021bia public\u0103 local\u0103. Avocata Viorelia Albu a explicat, \u00een cadrul rubricii Clinica Juridic\u0103 a ZdG, detaliile acestei proceduri, scrie <a href=\"https:\/\/www.zdg.md\/stiri\/stiri-sociale\/consultanta-juridica\/autorizarea-lucrarilor-de-constructii-locative-private-care-este-procedura\/\">zdg.md<\/a>.<\/strong><\/p>\n<p>Pentru a \u00eencepe procedura de autorizare a execut\u0103rii lucr\u0103rilor de construc\u021bie a unei case de locuit, a gardului capital sau a construc\u021biilor \u0219i anexelor gospod\u0103re\u0219ti mai mari de 15 metri p\u0103tra\u021bi este necesar ca solicitantul sa depun\u0103 o cerere prin care s\u0103 solicite eliberarea certificatului de urbanism pentru proiectarea \u0219i executarea cl\u0103dirii.<\/p>\n<p>Cererea se va depune pe numele primarului din cadrul Administra\u021biei Publice Locale (APL) unde se vor executa lucr\u0103rile de construc\u021bii. Se va \u021bine cont de locul amplas\u0103rii imobilului sau al terenului. La cerere se va anexa buletinul de identitate, iar \u00een caz de reconstruire sau modificare a imobilului existent, suplimentar se va prezenta raportul de expertiz\u0103 tehnic\u0103, elaborat de exper\u0163i tehnici atesta\u0163i.<\/p>\n<p>Avocata Viorelia Albu men\u021bioneaz\u0103 c\u0103 certificatul de urbanism pentru proiectare va fi elaborat \u0219i eliberat \u00een temeiul documenta\u021biei de urbanism \u0219i amenajare a teritoriului, \u00een cel mult 20 de zile lucr\u0103toare de la data \u00eenregistr\u0103rii cererii, iar \u00een cazul \u00een care imobilele sau terenurile sunt amplasate \u00een zonele cu un regim special, emitentul va elibera actul \u00een termen de p\u00e2n\u0103 la 30 de zile, cu ob\u021binerea avizelor prev\u0103zute de legisla\u021bie. Termenul de valabilitate a certificatului nu va dep\u0103\u0219i 24 de luni de la data emiterii. Acesta poate fi prelungit o singur\u0103 dat\u0103 pe un termen de p\u00e2n\u0103 la 12 luni. \u00cen baza certificatului de urbanism pentru proiectare, titularul acestuia va contracta un proiectant licen\u021biat pentru elaborarea proiectului care urmeaz\u0103 a fi avizat, verificat \u0219i aprobat .<\/p>\n<p><strong>Actele necesare pentru a ob\u021bine autoriza\u021bia de construire<\/strong><\/p>\n<p>\u201eExecutarea lucr\u0103rilor de construc\u021bii este permis\u0103 doar \u00een baza unei autoriza\u021bii de construire emis\u0103 \u00een condi\u021biile Legii nr. 163\/2010, ob\u021binut\u0103 \u00een temeiul cererii solicitantului, cu anexarea urm\u0103toarelor acte: buletinul de identitate, certificatul de urbanism sau certificatul constatator, extrasul din documenta\u0163ia de proiect, contractul privind supravegherea de autor, semnat de c\u0103tre solicitant \u015fi proiectant\u201d, explic\u0103 Viorelia Albu.<\/p>\n<p>C\u00e2nd imobilul sau terenul se afl\u0103 \u00een coproprietate, se va prezenta \u0219i acordul autentificat notarial al coproprietarilor care pot fi afecta\u021bi nemijlocit \u00een procesul execut\u0103rii lucr\u0103rilor de construc\u021bie \u0219i \u00een perioada exploat\u0103rii obiectului. Pentru proiectarea interven\u0163iilor la monumentele ocrotite de stat, se va anexa extrasul din procesul-verbal al \u015fedin\u0163ei Consiliului Na\u0163ional al Monumentelor Istorice de pe l\u00e2ng\u0103 Ministerul Educa\u0163iei, Culturii \u015fi Cercet\u0103rii (MECC) privind avizarea pozitiv\u0103 a proiectului de execu\u0163ie. \u00cen cazurile prev\u0103zute de legisla\u021bie, se va prezenta certificatul de desc\u0103rcare de sarcin\u0103 arheologic\u0103 \u0219i acordul de mediu.<\/p>\n<p>Chiar dac\u0103 la cerere nu au fost anexate toate documentele, aceasta va fi admis\u0103 \u015fi \u00eenregistrat\u0103. Emitentul poate suspenda examinarea pe un termen de p\u00e2n\u0103 la 30 de zile, cu \u00een\u015ftiin\u0163area obligatorie a solicitantului. \u00cen ziua \u00een care se vor prezenta toate actele, suspendarea va fi anulat\u0103.<\/p>\n<p>Avocata precizeaz\u0103 c\u0103, la solicitarea autoriz\u0103rii obiectelor din zona de protec\u021bie a drumului public, emitentul este obligat s\u0103 ob\u0163in\u0103 autoriza\u0163ia de amplasare \u00een conformitate cu Legea drumurilor. Autoriza\u0163ia de construire eliberat\u0103 \u00een lipsa autoriza\u021biei este nul\u0103.<\/p>\n<p>\u201eUltimele modific\u0103ri ale legii au simplificat procedura din contul reducerii mai multor acte care substituiau lipsa documenta\u021biei de urbanism, inclusiv a schi\u021bei de proiect, a schemelor de amplasare avizate, care erau prezentate de solicitan\u021bi la etapa elabor\u0103rii certificatului de urbanism pentru proiectare. Lipsa documenta\u021biei de urbanism \u00een unele localit\u0103\u021bi \u00eens\u0103 ar putea genera am\u00e2n\u0103ri de elaborare a actelor permisive, inclusiv cu riscul m\u0103ririi num\u0103rului construc\u021biilor neautorizate\u201d, consider\u0103 Viorelia Albu.<\/p>\n<p><strong>Care sunt taxele pentru elaborarea actelor permisive?<\/strong><\/p>\n<p>Plata pentru elaborarea actelor, stabilit\u0103 anual prin decizia consiliului local, nu va dep\u0103\u0219i suma de 50 de lei pentru certificatul de urbanism pentru proiectare \u0219i 100 de lei pentru autoriza\u021bia de construire. Termenul de valabilitate al certificatului de urbanism \u015fi al autoriza\u0163iei de construire sau desfiin\u0163are se prelunge\u0219te gratuit. Consiliile locale sunt \u00een drept s\u0103 acorde, \u00een limitele legii, facilit\u0103\u0163i pentru unele categorii de persoane.<\/p>\n<p><strong>Ce presupune aprobarea tacit\u0103?<\/strong><\/p>\n<p>Func\u021bionarul responsabil din cadrul prim\u0103rie, este obligat s\u0103 \u00eenregistreze cererea cu actele anexate ale solicitantului privind eliberarea actelor permisive \u0219i s\u0103 elibereze certificatul constatator. \u00cen cazul \u00een care APL a dep\u0103\u0219it termenul de eliberare, prelungire sau reperfectare a actelor permisive, sau nu a oferit r\u0103spuns \u00een scris privind refuzul eliber\u0103rii actului solicitat, solicitantul va avea dreptul s\u0103 \u00eenceap\u0103 executarea lucr\u0103rilor de construire, recurg\u00e2nd la procedura aprob\u0103rii tacite.<\/p>\n<p>Dac\u0103 emitentul nu a respectat termenul de 30 de zile lucr\u0103toare \u015fi nu a informat \u00een scris solicitantul privind refuzul s\u0103u, autoriza\u0163ia de construire se consider\u0103 eliberat\u0103. \u00cen acest caz, solicitantul este \u00een drept s\u0103 \u00eenceap\u0103 executarea lucr\u0103rilor, invoc\u00e2nd principiul aprob\u0103rii tacite, cu informarea organelor competente.<\/p>\n<p><strong>Care este termenul de \u00eencepere a lucr\u0103rilor de construc\u021bie \u0219i durata execut\u0103rii acestora?<\/strong><\/p>\n<p>Solicitantul va \u00eencepe lucr\u0103rile de construc\u0163ie p\u00e2n\u0103 la survenirea termenului de \u0219ase luni din data eliber\u0103rii autoriza\u021biei de construire. \u00cen caz contrar, autoriza\u021bia \u00ee\u0219i pierde valabilitatea. Solicitantul poate cere prelungirea termenului de \u00eencepere a lucr\u0103rilor de construc\u021bie doar o singur\u0103 dat\u0103 \u0219i \u00een cazuri motivate cu, cel pu\u021bin, zece zile lucr\u0103toare \u00eenaintea expir\u0103rii, pe un termen de p\u00e2n\u0103 la \u0219ase luni. Lucr\u0103rile de construc\u021bie \u00eencepute \u00een termen ofer\u0103 valabilitate autoriza\u021biei pentru toat\u0103 durata execut\u0103rii lucr\u0103rilor, explic\u0103 avocata.<\/p>\n<p>Totodat\u0103, solicitantul autoriza\u0163iei de construire este obligat ca \u00een termen de zece zile lucr\u0103toare p\u00e2n\u0103 la \u00eenceperea lucr\u0103rilor autorizate s\u0103 informeze Agen\u0163ia pentru Supraveghere Tehnic\u0103.<\/p>\n<p><strong>\u00cen ce cazuri poate fi refuzat\u0103 eliberarea autoriza\u021biei de construire?<\/strong><\/p>\n<p>APL poate refuza eliberarea autoriza\u021biei atunci c\u00e2nd solicitantul nu este proprietarul imobilului sau al terenului pentru care solicit\u0103 autoriza\u021bia de construire sau nu are acordul coproprietarilor sau \u00een cazul \u00een care documenta\u021bia de proiect a fost elaborat\u0103 cu \u00eenc\u0103lcarea prescrip\u0163iilor \u015fi a elementelor stabilite prin certificatul de urbanism pentru proiectare, dac\u0103 lipsesc avizele pozitive stabilite prin certificat \u0219i actele normative care trebuie s\u0103 \u00eenso\u021beasc\u0103 cererea privind solicitarea autoriza\u021biei de construire.<\/p>\n<p><strong>Ce lucr\u0103ri de construc\u021bie pot fi efectuate f\u0103r\u0103 certificat de urbanism \u0219i f\u0103r\u0103 autoriza\u021bie de construire?<\/strong><\/p>\n<p>Legea privind autorizarea lucr\u0103rilor de construc\u021bii prevede c\u0103 lucr\u0103rile care se pot executa \u00een lipsa actelor permisive sunt doar cele care nu modific\u0103 structura de rezisten\u0163\u0103, aspectul exterior, caracteristicile ini\u0163iale ale construc\u0163iilor. Astfel, f\u0103r\u0103 acte permisive se pot repara \u00eemprejurimile, acoperi\u0219ul, pot fi \u00eenlocuite pardoselile \u0219i piesele de t\u00e2mpl\u0103rie, dac\u0103 nu se modific\u0103 forma acestora, pot fi efectuate lucr\u0103ri de finisare \u00een interior sau exterior, dac\u0103 nu se modific\u0103 elementele de fa\u0163ad\u0103, pot fi \u00eenlocuite sau reparate sobele, instala\u021biile, sistemele \u0219i utilajul tehnico-sanitar din interiorul cl\u0103dirilor. F\u0103r\u0103 acte permisive se pot repara c\u0103ile de comunica\u0163ii, parc\u0103rile, trotuarele sau sc\u0103rile, dac\u0103 se men\u021bine suprafa\u021ba \u0219i volumetria acestora.
