Acestea sunt destul de pronun\u021bate \u00een domeniile statului de drept, anticorup\u021biei, combaterii sp\u0103l\u0103rii banilor \u0219i combaterii finan\u021b\u0103rii terorismului \u0219i guvern\u0103rii SOE, \u00een timp ce alte domenii, guvernarea b\u0103ncii centrale \u0219i supravegherea sectorului financiar au prezentat unele progrese bune \u00een atenuarea acestor vulnerabilit\u0103\u021bi. Prezentele afirma\u021bii se reg\u0103sesc \u00een cadrul unui raport al Fondului Monetar Interna\u021bional (FMI), ca r\u0103spuns la o cerere din partea autorit\u0103\u021bilor din Republica Moldova. Raportul a fost realizat de o echip\u0103 organizat\u0103 de Departamentele Afaceri Fiscale (FAD), Juridice (LEG) \u0219i ale Pie\u021belor Monetare \u0219i de Capital (MCM) ale FMI, care a efectuat o evaluare a guvern\u0103rii R. Moldova \u00een perioada 24 iulie-august 7, 2020, c\u00e2nd \u00een fruntea Guvernului se afla Ion Chicu, scrie <a href=\"https:\/\/deschide.md\/ro\/stiri\/economic\/89180\/DOC--Raport-FMI-R-Moldova-continu%C4%83-s%C4%83-sufere-de-corup%C8%9Bie-%C8%99i-guvernare-vulnerabil%C4%83.htm\">deschide.md<\/a>.<\/strong><\/p>\n<p>Statul de drept \u00een Moldova este slab, cu o implementare slab\u0103 a cadrelor legale \u0219i de reglementare, se men\u021bioneaz\u0103 \u00een raport. Sistemul de justi\u021bie este recunoscut pe scar\u0103 larg\u0103 ca fiind ineficient \u0219i susceptibil la corup\u021bie \u0219i capturare, principalii actori judiciari (inclusiv judec\u0103tori, procurori, anchetatori criminali \u0219i executori judec\u0103tore\u0219ti) percepu\u021bi ca lipsi\u021bi de integritate \u0219i independen\u021b\u0103. Aceste aspecte par, de asemenea, a fi principalele motive pentru protec\u021bia deficitar\u0103 a drepturilor de proprietate \u0219i executarea contractelor, precum \u0219i aplicarea necoerent\u0103 a cadrului juridic comercial. Un stat de drept slab \u00een Moldova este citat ca un factor de descurajare pentru investi\u021biile str\u0103ine directe \u0219i dezvoltarea sectorului privat, spun speciali\u0219tii FMI.<\/p>\n<p>Conform raportului, infrastructura juridic\u0103 \u0219i institu\u021bional\u0103 anticorup\u021bie este \u00een mare m\u0103sur\u0103 \u00een vigoare, dar nu are eficien\u021b\u0103 \u0219i trebuie izolat\u0103 de influen\u021ba nejustificat\u0103. Anchetele de corup\u021bie se concentreaz\u0103 mai degrab\u0103 pe mit\u0103 m\u0103runt\u0103 \u0219i pe cet\u0103\u021beni priva\u021bi dec\u00e2t pe func\u021bionari publici, \u00een timp ce unele tipuri de corup\u021bie, cum ar fi delapidarea, nu sunt urm\u0103rite \u00een mod adecvat. Sanc\u021bionarea \u00een cazurile de corup\u021bie pare \u00eeng\u0103duitoare cu aplicarea pe scar\u0103 larg\u0103 a amenzilor \u0219i reducerea \u0219i suspendarea pedepsei. Eforturile de aplicare a legii trebuie s\u0103 fie mai bine direc\u021bionate c\u0103tre corup\u021bia la nivel \u00eenalt, prin aplicarea de sanc\u021biuni disuasive.<\/p>\n<p>Speciali\u0219tii au constatat c\u0103 regimul\u00a0Combaterii sp\u0103l\u0103rii banilor \/ Combaterii finan\u021b\u0103rii terorismului\u00a0\u00een Moldova (AML \/ CFT) , de\u0219i este puternic \u00een unele domenii, nu este \u00eenc\u0103 suficient utilizat pentru a sprijini eforturile anticorup\u021bie \u0219i a proteja economia \u021b\u0103rii de fluxurile ilicite (inclusiv cele care provin din acte corupte). \u00cen\u021belegerea riscurilor de sp\u0103lare a banilor asociate corup\u021biei \u0219i aplicarea m\u0103surilor preventive (cum ar fi cele care vizeaz\u0103 identificarea proprietarilor efectivi \u0219i a persoanelor expuse politic) sunt \u00eenc\u0103 inadecvate. Instrumentele AML \/ CFT ar putea fi, de asemenea, folosite mai bine pentru a sprijini aplicarea penal\u0103 \u0219i eforturile de recuperare a activelor.<\/p>\n<p>\u00cen ceea ce prive\u0219te problema \u00eentreprinderilor de stat (\u00ceS), cadrul institu\u021bional pare fragmentat, predispus la schimb\u0103ri bru\u0219te \u0219i propice pentru estomparea responsabilit\u0103\u021bilor institu\u021bionale. Privatizarea activelor de stat \u0219i a \u00eentreprinderilor de stat r\u0103m\u00e2ne o preocupare grav\u0103. Recomand\u0103rile includ:\u00a0<em>dezvoltarea unei metodologii de triaj care justific\u0103 proprietatea de stat \u0219i dezinvestirile de stat, \u00eempreun\u0103 cu o politic\u0103 de proprietate de stat care s\u0103 eficientizeze cadrul institu\u021bional \u0219i s\u0103 stimuleze profesionalismul consiliului de administra\u021bie \u0219i al managementului.<\/em><\/p>\n<p>\u00cen ceea ce prive\u0219te gestionarea finan\u021belor publice (PFM), controalele \u0219i transparen\u021ba sunt puternice pentru cheltuielile bugetare principale, dar mai pu\u021bin pentru cheltuielile \/ tranzac\u021biile din afara \u201ecadrului principal\u201d. Recomand\u0103rile includ:\u00a0<em>stabilirea unui cadru pentru transparen\u021ba fondurilor, un cadru pentru 9 proiecte \u00een afara cadrului \u201einvesti\u021biei de capital\u201d, monitorizarea leasingului terenurilor autorit\u0103\u021bilor publice locale, monitorizarea sistematic\u0103 a achizi\u021biilor, acoperirea \u0219i conectarea sistemelor IT \u0219i consolidarea capacit\u0103\u021bii pentru sistemele interne audituri.<\/em><\/p>\n<p>\u00cen ceea ce prive\u0219te administrarea impozitelor, Serviciul Fiscal de Stat (STS) a f\u0103cut progrese semnificative \u00een reducerea vulnerabilit\u0103\u021bii la corup\u021bie, dar percep\u021biile comunit\u0103\u021bii asupra corup\u021biei \u00een STS r\u0103m\u00e2n ridicate. Recomand\u0103rile includ urm\u0103toarele:\u00a0<em>modific\u0103ri ale legii privind numirea directorului STS \u0219i \u00eembun\u0103t\u0103\u021biri ale guvernan\u021bei riscului de corup\u021bie, proceduri de resurse umane, securitatea datelor \u0219i monitorizarea auditorilor fiscali. Recomand\u0103rile referitoare la o modificare a legii propuse pentru a da puterilor de investigare penal\u0103 STS includ am\u00e2narea punerii \u00een aplicare p\u00e2n\u0103 c\u00e2nd sunt instituite proceduri solide \u0219i anchetatori suficien\u021bi verifica\u021bi \u0219i bine preg\u0103ti\u021bi pentru integritate; \u0219i, reduc\u00e2nd dimensiunea propus\u0103 a subdiviziunii de anchet\u0103 penal\u0103 STS.<\/em><\/p>\n<p>\u00cen ceea ce prive\u0219te guvernarea b\u0103ncii centrale, recenta evaluare a garan\u021biilor FMI a constatat c\u0103, de\u0219i structura de guvernan\u021b\u0103 a B\u0103ncii Na\u021bionale a Moldovei (BNM) cu o supraveghere independent\u0103 puternic\u0103 este \u00een general adecvat\u0103, \u00eencerc\u0103rile de a pune \u00een pericol autonomia BNM au un impact general asupra sistemului general de controale interne. \u00cen consecin\u021b\u0103, sunt necesare modific\u0103ri la Legea BNM, care este \u00een linie mare cu cele mai bune practici, pentru a consolida independen\u021ba BNM, pentru a-\u0219i \u00eembun\u0103t\u0103\u021bi guvernan\u021ba \u0219i pentru a proteja independen\u021ba opera\u021bional\u0103 a func\u021biei de supraveghere pruden\u021bial\u0103 a BNM.<\/p>\n<p>\u00cen ceea ce prive\u0219te supravegherea sectorului financiar, cadrele legislative \u0219i de reglementare sunt \u00een mare parte \u00een vigoare, \u00een scopuri pruden\u021biale, reflect\u00e2nd eforturi considerabile, de\u0219i sunt necesare modific\u0103ri suplimentare pentru a sprijini guvernan\u021ba \u0219i independen\u021ba b\u0103ncii centrale. S-au f\u0103cut progrese bune \u00een reducerea expunerilor p\u0103r\u021bilor afiliate ale b\u0103ncilor. Mai general, \u00eens\u0103, implementarea practic\u0103 a noilor standarde de supraveghere care supravegheaz\u0103 practicile de guvernan\u021b\u0103 corporativ\u0103 \u00een b\u0103nci este slab\u0103. Aceste dou\u0103 condi\u021bii stau la baza tuturor recomand\u0103rilor f\u0103cute \u00een aceast\u0103 sec\u021biune a raportului. De\u0219i s-a observat c\u0103 interac\u021biunea dintre BNM \u0219i instan\u021be nu este o problem\u0103 nou\u0103 \u0219i a constituit o preocupare major\u0103 \u00een Programul de evaluare a sectorului financiar (FSAP), autorit\u0103\u021bile \u0219i-au \u00eembun\u0103t\u0103\u021bit cadrul din 2013 \u0219i, de\u0219i dispozi\u021biile privind controlul judiciar aplicabile BNM au devenit mai avansate dec\u00e2t multe jurisdic\u021bii, problemele care stau la baza legate de problemele mai largi de guvernan\u021b\u0103 au prevenit rezultate semnificative. F\u0103r\u0103 aceste condi\u021bii, este pu\u021bin probabil s\u0103 se realizeze progrese suplimentare \u00een Moldova, iar progresele existente vor fi din motive fragile. Cu alte cuvinte, progresele \u00een guvernan\u021b\u0103 \u00een ceea ce prive\u0219te supravegherea sectorului financiar nu pot fi realizate separat de reformele mai ample \u0219i mai profunde, care sunt discutate \u00een alte sec\u021biuni ale acestui raport (\u00een special, Sec\u021biunea II privind statul de drept \u0219i Sec\u021biunea VIII privind guvernan\u021ba b\u0103ncii centrale). Personalul de supraveghere necesit\u0103 protec\u021bie juridic\u0103 sporit\u0103 (care nu trebuie confundat\u0103 cu imunitatea la neglijen\u021b\u0103 grav\u0103). Aceste modific\u0103ri pot fi realizate prin modific\u0103ri legislative. Mai mult, utilizarea legilor modificate corespunz\u0103tor depinde de faptul c\u0103 Republica Moldova poate \u00eencuraja o aplicare transparent\u0103 \u0219i consecvent\u0103 a legii, printr-o justi\u021bie eficient\u0103 \u0219i independent\u0103 \u0219i disponibilitatea unor profesioni\u0219ti competen\u021bi, independen\u021bi \u0219i cu experien\u021b\u0103 (avoca\u021bi). La momentul FSAP din 2014, existau multe puncte slabe \u0219i este clar c\u0103 persist\u0103 multe provoc\u0103ri.<\/p>\n<p>Evaluarea guvernan\u021bei Moldovei s-a realizat \u00een conformitate cu Cadrul FMI pentru angajarea consolidat\u0103 a fondurilor pe probleme de guvernan\u021b\u0103 aprobat de Comitetul executiv \u00een aprilie 2018.
